Terms of Service

All Web Design services provided by ONNA Web Design (Hillary Summerton) are subject to the following terms and conditions.

Quotes & Contracts

Quotes provided to prospective clients will be honored for 30 days. After 30 days a new quote may need to be issued. In some cases, I may require a contract for work to be performed to be signed and dated by the client before work ensues.

Charges & Fees

All new web design projects require full payment upon completion of the project and before the site is transferred to the client’s hosting company. In some cases, a 50% deposit may be required before I begin work on your website, with the remaining 50% due upon completion.

Any check payments that do not clear will be charged a $35 fee. I retain the right to hold all websites and graphics created by me until payment is received for such items. (see copyright & ownership clause)

If you’ve signed up for monthly maintenance (with or without hosting) at $30/month, you have the right to cancel at any time. Simply call 360-320-8442 or email me. Refunds are provided within 5 days of charge date. Cancellations done after 5 days of charge date will not receive a refund.

Payments

I accept payments via Cash, Check, PayPal, Zelle, Stripe and all major Credit Cards. A service fee of 2.9% + .30¢ transaction fee will be added to credit card charges above $500.

Web Site Design Credits

All sites I create will have a “Designed by ONNA Web Design” or “Website by ONNA Web Design” link in the footer of their web site. By hiring me to work on your website you are agreeing to this, and that you understand that this link may NOT be removed without my consent.

Copyright & Ownership

The client understands that all files, web pages, graphics and programming work, except those provided by themselves, are the property of me (ONNA Web Design) until any and all fees are paid in full at which time the client retains ownership.

I reserve the right to display web sites and graphics that have been designed by me for clients on my web site, ONNA Web Design.

Refunds

I do not require payment for design services until you, the client, are happy with the website and it (the website) is live. Once a website is live and the invoice has been paid there are no refunds.

Late Payment

Payment for services are due upon receiving the invoice. After 30 days, if I don’t receive any direct communication from the client, all account activity including hosting, maintenance and email accounts will be suspended. After 60 days the account will be considered abandoned and all account files removed from ONNA Web Design servers.

Development & Delivery

I understand the importance of completing projects in a timely manner. I agree to deliver the requested work in a timely manner and shall conform to the standards as agreed. I charge for design work based on time, so any changes to the contract document once work has commenced, may result in changes in the fees already stated. If there are any increase in fees, they will be discussed beforehand with the client.

Proofreading

My responsibility for typographical, pricing, or other errors shall be strictly limited to correcting such errors if they are pointed out to me during timely proofreading and site testing. It is the client’s responsibility to proofread all work and to ensure that it is (a) satisfactory, (b) correct as to size, content etc, (c) suitable for intended use, and (d) within proper copyright and other restrictions before the website is opened to the public.

Non-Communication

If I am unable to communicate with a client on a project for a duration of at least thirty days (30) by phone or email during the design and development process, the project will be canceled and not renewed.

Liability

Services purchased from ONNA Web Design are provided “as is” without warranty of any kind that the web design project will be uninterrupted or error free. In no event shall ONNA Web Design be liable to the client for any direct, indirect, special, punitive, incidental, or consequential damages arising out of the use of the web site, services, and/or goods provided to the client. This includes, without limitation, lost profits, business interruption, loss of data or other losses directly resulting from the use of the web site, services, and/or goods provided to the client. The entire risk as to the quality and performance of the web design is with the client.

3rd Party Themes and Plugins

I use plugins that were created by 3rd party companies on new and existing WordPress websites. Occasionally, plugins may be abandoned by their developers, meaning no future updates or feature additions are expected. The primary concern with outdated plugins is the potential for security issues, as they might become targets for hackers if they aren’t actively maintained or updated. ONNA Web Design can not be held responsible if you have an outdated or abandoned plugin and your website is compromised. I stress the importance of updates with clients on every site I develop. 

Acceptable Use/Activity

I strive to maintain a high level of service and a high standard of quality in the websites I create. I will not provide services to anyone who’s site will include hate speech, racism, or any other content that is obscene, abusive, and which could be considered libelous or defamatory.

International Customers

I am happy to accept projects from customers outside of the United States and the same terms apply from above.

Acceptance

Please note that by submitting payment for my services you are agreeing to all of my terms of service as written here. I reserve the right to change or update these terms at any time without prior notice.
